These Terms of Service (Terms) govern the use of services provided by Cover Me Lien Services (CMLS, we, our, or us). By engaging CMLS or using our services, the client (Client or you) agrees to these Terms.
01Nature of Services
CMLS provides document preparation, processing, and administrative support services related to construction notices and lien-related filings, including:
- Preliminary Notices.
- Mechanics Liens.
- Stop Notices.
- Bond Claims.
- Waivers and Releases.
- CMLS provides operational and administrative services only.
02No Legal Advice - Non Attorney Disclosure
CMLS is not a law firm and does not provide legal advice. CMLS does not:
- Interpret laws for the client.
- Recommend legal strategies.
- Determine legal rights or eligibility.
- Perform enforcement actions, including lawsuits or foreclosure.
- Clients are advised to consult a licensed attorney for legal guidance.
03Client Responsibilities
The Client agrees to:
- Provide accurate, complete, and timely information.
- Review all documents prior to approval or submission.
- Respond promptly to requests for additional information.
- Understand that deadlines are statutory and time-sensitive.
- CMLS relies entirely on information provided by the Client.
04Deadlines and Limitations
CMLS identifies and tracks deadlines as an operational control but does not guarantee preservation of legal rights. The Client acknowledges:
- Deadlines cannot be extended by CMLS.
- Delays in providing information may result in loss of rights.
05Authorization to Act
By engaging CMLS, the Client authorizes CMLS to:
- Prepare documents on the Client's behalf.
- Serve notices and claims.
- Coordinate filing or recording where applicable.
- Authorization is limited strictly to administrative functions.
06Service Execution
Services may include:
- Document preparation.
- Mailing, including certified mail.
- Agency filing or recording.
- Proof of service documentation.
- CMLS may utilize third-party services, including mailing providers and recording agencies.
07Fees and Payment
Fees are based on:
- Document type.
- Service level, DIY or full service.
- Filing or mailing requirements.
- Payment is due at the time of service request unless otherwise agreed.
- All fees are subject to the Refund Policy.
08No Guarantee of Payment
CMLS does not guarantee that a lien or claim will result in payment or that funds will be recovered. All outcomes depend on factors beyond CMLS control.
09Enforcement and Attorney Referral
CMLS does not perform enforcement actions, including lien foreclosure or bond claim lawsuits. If enforcement is required, the Client must engage a licensed attorney.
10Limitation of Liability
To the fullest extent permitted by law, CMLS is not liable for:
- Errors resulting from incorrect client information.
- Missed deadlines caused by delayed submission.
- Outcomes of claims or disputes.
- Indirect or consequential damages.
11Record Retention
CMLS retains documents and records for operational and compliance purposes. Clients may request copies of their documents at any time.
12Modifications
CMLS may update these Terms from time to time. Continued use of services constitutes acceptance of updated Terms.
